Learned counsel for the petitioner submits that only prayer in this case is that the enquiry which was contemplated under Section 40 of the Panchayat Raj Adhiniyam, 1993 though the time is provided that it should be concluded within 90 days, the same is not being done and despite the fact that after hearing, the matter was fixed for orders, but no orders have been passed, which would be evident from the order dated 28.10.2017, therefore, the Court below may be directed to decide the case within specified period of time.

Perused the documents filed alongwith the petition as also the order sheet. The order sheet dated 28.10.2017 would show that

the case was fixed for orders and as appears no orders have been passed.

In view of the fact that the case is only fixed for orders, the S.D.O. Bilaigarh is directed to decide the case bearing No.45/2016-17 in respect of the petitioner within a period of 30 days from the date of receipt of a copy of this order.
