1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.68/2016, registered at Police Station Khursipar, Distt. Durg, for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, 1915.
2. Case of the prosecution, in brief, is that 7.74 bulk litres of liquor was seized from the possession of the present applicant.
3. Although the quantity of liquor seized from the applicant is only 7.74 bulk litres, however, the applicant is involved in at least nine offences registered against him under different Sections of the IPC.
4. Considering the entirety of the circumstances, this Court is not inclined to release the applicant on bail, at this stage. Accordingly, the bail application is dismissed. However, the applicant would be at liberty to revive after three months.
