This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.222/2015 registered at Police Station- Bhakhara, District Dhamtari (C.G.) for the offence punishable under Section 363, 366 of Indian Penal Code and Section 4 of Protection of Children from Sexual Offences Act, 2012.

Learned counsel for the applicant submits that the prosecutrix in this case has been examined, however, he is not in hold of the statement and few of the witnesses are still remains. 3.

Taking into fact that the prosecutrix has already been examined, in the considered opinion of this Court, it is to be appreciated by the trial Court.

Considering the fact that the prosecutrix has been examined and few of the witness are still remained to be examined, the bail application is dismissed.
