18.08.2021 Heard on prayer for grant for leave to appeal. Taking into consideration the submission of learned State counsel that though clinching evidence of last seen of the accused in the house of the deceased in the night, there being a dispute and that deceased going out to call his brother in the night, appellant following and thereafter deceased found dead near a tree and the clothes of the appellant, blood stained soil at the spot and the axe having been found to be stained with blood of A Group, acquittal has been ordered, we are inclined to grant to leave to appeal.

Let the appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.

CRMP is accordingly disposed off.
