Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /09/2021 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.126/2019 registered in Police Station Kotwali, District Dhamtari for offence under Section 420/34 of the IPC and Sections 4, 5, 6 of the Prize Chits and Money Circulation Scheme (Banning) Act, 1978 and Section 6, 10 of the Chhattisgarh Protection of Depositors Interest Act, 2005.

2. The applicant along with co-accused Yashwant Sonkar, Hemant Dewangan, Mayank Sonkar, Kuleshwar Sonkar & several other persons being In-charge of affairs of Mahanadi Advisory Services Private

MCRC No. 5633 of 2021 Limited Company defrauded the depositors to the tune of Rs.1,46,41,897/- by alluring/inducing them of doubling the amount in short time.

3. Admittedly, co-accused Yashwant Sonkar and Hemant Dewangan have been enlarged on bail in MCRC Nos.9450/20 & 2717/2021 respectively by the coordinate Bench.

4. Therefore, considering that this applicant is in jail since 2.3.2020 i.e. for about 11⁄2 years, I am inclined to release him on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
