This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 236/2015, registered at Police Station Jashpur, District Jashpur (C.G.), for the offence punishable under Sections 363, 366-A, 376 of Indian

Penal Code, Section 3, 4 of the Protection of Children from Sexual Offences Act,2012 and Section 3(1)(10) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case, nature and gravity of offence; and manner in which, applicant who is married man abducted minor prosecutrix and subjected to forcible sexual intercourse with her on 30/07/2015, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
