1. The grievance of the petitioner in the present writ petition seems to be the non settlement of the post retirement benefits which the petitioner is entitled for.

2. According to the petitioner he has crossed the age of superannuation on 31.07.2016. The petitioner at the time of retirement was working on the post of Cartographer (Manchitrakar) in Tehsil Office at Gariyaband.

-2According to the petitioner, post retirement though it is more than five years he has not received any retiral dues.

3. Counsel for the petitioner submits that immediately before his retirement for a considerable period of time the petitioner because of ill health was not able to resume his duties and he has applied for sanctioned medical leave for the said period which too is till date pending consideration before the authorities concerned. It is further contention of the petitioner that against the non settlement of the retiral dues payable to the petitioner he has already preferred a representation before the authorities concerned but there has been no decision on the same.

Given the limited grievance that petitioner has the writ petition at this juncture stands disposed of directing the respondent no.2 to 4 to take appropriate decision on the claim of the petitioner in accordance with rules governing the field at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.

5. The claim of the petitioner shall be decided by a speaking order. The authorities also are expected to take a decision on the period of absence for which the petitioner has already approached for grant of medical leave in accordance with the rules governing the field.

6. With the aforesaid observation, the Writ Petition accordingly stands disposed of.
