Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/05/2016 The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 129/2015, registered in Police Station Devendra Nagar, District : Raipur for offence punishable under Sections 294,506,323,341,147,149 and 306 IPC.

Case of the prosecution in brief is that on 04.11.15, the applicant along with five other co-accused persons assaulted the deceased Rohit Singh @ Dharnidhar Pratap Singh and his brother Parikshit Singh as a result of which Rohit Singh committed suicide on account of frustration and humiiliation.

It is not disputed that co-accused Keshav Baghel has been released on regular bail vide order dated 10.03.16 passed in M.Cr.C. No. 1185/2016 and co-accused Sanjay Gaien @ Sanju Banglai has been released vide order dated 04.04.16 passed in M.Cr.C. No. 1776/2016. 4.

Considering the entirety of the case, in particular the fact that similarly situated co-accused persons have already been released on bail, I am of the opinion that it is a fit case where the applicant can be released on bail.

Accordingly, the bail application is allowed. It is directed that in the event of the applicant's executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court, he shall be released on bail. He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. Sd/- Prashant Kumar Mishra Vacation Judge suguna
