Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 08/01/2018 The transfer order is under challenge by the petitioner who claims to be 55% disabled on the ground that his transfer to Gevra Road may lead to serious inconvenience to the petitioner.

Clause 8 of the transfer policy provides that the transfer of a physically handicapped officer will be governed by Government of India guidelines though that will not be applicable in case of disciplinary action. 3.

Shri Roy appearing on advance copy for respondents would submit that the representation of the petitioner is pending and the same will be considered and decided within 15 days.

Considering the said submission, I am not inclined to keep the matter pending

but to dispose off this petition with a direction that the respondents shall decide the representation of the petitioner within 15 days from today. For a period of 15 days, the petitioner shall not be compelled to proceed on transfer.
