(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.16/2015, registered at Police Station Koilibeda, District Kanker, for the offence punishable under Section 376 of the Indian Penal Code.

(3) The first and second bail applications of the applicant were dismissed on merit by order of this Court dated 14.09.2015 passed in M.Cr.C. No.4782/2015 and dated 15.01.2016 passed in M.Cr.C. No.369/2016.

(4) After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case, material evidence available on record, statement of prosecutrix recorded on 22.02.2016 before the trial Court and that the applicant's SLP (Cri.) being No.1643/2016 has already been dismissed by Hon'ble Supreme Court vide order dated 04.03.2016, I do not find any change in circumstances to entertain this third bail application. Thus, the bail application is rejected.
