The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.219/2016, registered in Police Station : Civil Lines, Bilaspur for the offence punishable under Sections 420, 467, 468, 471 read with Section 120B of the IPC. 2.

The applicant is engaged in sale and distribution of SIM Cards of TATA Docomo. It is alleged that the applicant issued SIM Cards to Yash Mobile and Taj Mobile, who are retailers and who in turn distributed the SIM Cards to fake individuals without ascertaining their identities and existence.

Learned counsel for the State would oppose the application on submission that the law enforcing agencies are facing difficulties to trace criminals and other individuals involved in various activities because they are issuing SIM Cards in the name of fake persons. 4.

Having considered that the applicant is in jail since 03.04.2016, the offences are triable by Judicial Magistrate First Class and there is no requirement of custodial interrogation of the applicant, this Court is inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court.
