Hon'ble Smt. Justice Rajani Dubey Order on Board 14.09.2020

1. Learned counsel for the applicant submits that on 11.08.2020 in MCRC No. 4686/2020 he has simply withdrawn the bail application, but due to some network problem during video conferencing, he could not make his submission properly and the order has been passed that "Learned counsel for the applicant wants to withdraw this petition with liberty to revive the same after examination of the material witnesses". In this regard, he has also submitted an affidavit. He further submits that the order dated 11.08.2020 passed in MCRC No. 4686/2020 may be modified and order of simple withdrawal may be passed.

2. Considered the submission and prayer of learned counsel for the applicant.

3. Consequently, the order dated 11.08.2020 passed in MCRC No.4686/2020 is modified and the same may be read as under:- "Learned counsel for the applicant wants to withdraw this petition.

Prayer is allowed.

Accordingly, this application is dismissed."

4. The order dated 11.08.2020 passed in MCRC No. 4686/2020 is modified to this extent.

5. Cr.M.P. No.1122/2020 stands disposed of .
