1. The petitioner's mother died in harness on 17-7-1996 while

W.P.(S)No.25/2015 working as Assistant Grade-III at Bilaspur. Application for compassionate appointment was filed on 21-11-1996 and reminder has been made on 13-3-2012. By the impugned order Annexure P-7, the competent authority has rejected the application holding that the Government servant died on 17-7-1996 and there is no instruction for granting compassionate appointment for cases of 1996.

2. The State of Chhattisgarh has taken a decision to consider the cases of compassionate appointment of Government servants who died after the formation of the State i.e. 1-112000 and further taken a decision on 2-2-2006 that any Government servant who died during the period from 1-11997 to 1-11-2000 while posted in the territorial area of present State of Chhattisgarh, their cases for compassionate appointment shall be considered by the State of Chhattisgarh.

3. In view of the policy decision of the Government, the petitioner's case cannot be considered by the State of Chhattisgarh. Therefore, the writ petition is dismissed in view of the policy decision of the Government as well as on the ground of delay. No order as to costs.
