1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No. 336/2015, registered at Police Station Arjuni, District Dhamtari (C.G.), for the offence punishable under Section 419, 420, 467, 468, 201, 120-B of I.P.C.

2. Applicant along with one Lomesh Sahu, who was the Manager of Shyam Cold Storage, Arjuni has allegedly sold 1300 bags (katta) of Mahuwa to Chhotu @ Indresh Dewangan for Rs. 9 Lakhs, the said Mahuwa was deposited by one Vinod Sao in the Cold Storage belonging to Nanak Chand Agrawal.

3. In the memorandum statement of the present applicant he has stated that Manager Lomesh Sahu has used him for sale of Mahuwa, has retained Rs. 9 Lakhs and out of

which only Rs.1 Lakh has been given to the present applicant, who does not even work in the Cold Storage.

4. It appears Lomesh Sahu is the main accused in the present crime.

5. Considering the fact situation of the case and for the fact that the applicant is in jail since 27/12/2015 and the charge-sheet has already been filed, this Court is inclined to release him on bail.

6. It is directed that in the event of applicant's executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court concerned, he shall be released on bail.
