Heard Perused the statement of the appellant Chedilal Patel wherein it is stated he is unemployed and he has four sons and four daughters and their daughters were married, they were not supporting to him. Further in name of his wife, 7 Kg Rice is being granted and he do not have any other source of income. He submits that at village Bhathri, he has 40 dismil land, which too were mortgaged by Rubel Kumar Mashih respondent herein for Rs.30,000/-. Perused the report of the State wherein it is stated that the applicant is receiving Rs.35,000/- per year and he is a labour. Taking into totality of the facts and statement, the application under Order 44 Rule 1 of C.P.C. is allowed. The applicant is allowed to contest the appeal as an indigent person.
Registry is directed to register the MCC as First Appeal. List after two weeks.
