The Applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.131/2016 registered in P.S. Mahasamund, Distt. Mahasamund (CG) for the offence punishable under Section 34(2) of the Excise Act for possessing 12 bulk liters of country made liquor.

Having heard learned counsel for the parties, having regard to the quantity of the contraband and the fact that the Applicants do not have any criminal antecedent, as has been admitted by learned counsel for the State and also considering that the Applicants are in custody since 31.03.2016, the application is allowed. It is directed that in the event of Applicants' executing a personal bond for a sum of Rs.25,000/- with two sureties each for the like amount to the satisfaction of the concerned Trial Court, they shall be released

on bail. They shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. 3.

However, it is made clear that in case the Applicants involve themselves in identical offence in future, this order granting bail to the Applicants shall automatically stand cancelled without reference to the Bench. Sd/- (Prashant Kumar Mishra) Vacation Judge Priya
