Hon'ble Mr. Justice Parth Prateem Sahu Order On Board 04/8/2021
1. Learned counsel for the petitioners submits that similarly situated petitioners have earlier preferred writ petition before this Court bearing WPC No.2306/2020, which came to be disposed of vide order dated 9.11.2020 directing the petitioner therein to approach the Registrar, Indira Gandhi Krishi Vishvavidyalaya for appropriate orders. Based upon the order passed in WPS No.2306/2020, several other petitions were also filed by the persons who are having similar grievance as
raised by present petitioner and the same were also disposed of in the light of order dated 9.11.2020 passed in WPC No.2306/2020. Learned counsel submits that the petitioners in WPS No.1690/2021 and other connected matters have approached the authority concerned by filing representation and the authority concerned has considered their representation, as is evident from Annexure P-8. He submits that this petition may also be disposed of in similar terms.
2. Mr. Jitendra Pali, learned Deputy Advocate General for the State as also Mr. Shashank Thakur, learned counsel for respondent Nos.2 & 3 submit that they have no objection if this petition is disposed of in light of the order passed in WPS No.1690//2021 and other connected matters.
3. I have heard learned counsel for the parties.
4. Writ Petition (S) No.1690/21 and other connected matters were disposed off by observing as under:- "2. In WPC/2306/2020, following order has been passed :- "4. Be that as it may, since from the pleadings it is evidently clear that identically placed persons have been granted permission on the order issued by the State Authorities, the present writ petition can also be disposed of directing the petitioner to first approach the Registrar of the University for an appropriate order in this regard and based upon which the petitioner shall also approach the State authorities for a similar relief as has been granted to other similarly placed candidates and on getting such permission from the State authorities, the respondent University shall consider granting of permission to the petitioner for completing her course in the light of the order passed by the State Govt."
3. The instant writ petitions are accordingly disposed of in
terms of the order dated 09/11/2020 passed in WPC 2306/ 2020 and the State Government is directed to consider and dispose of petitioners' representations within 15 days from the date of receipt of a copy of this order in compliance of the applicable rules and regulations and also communicate the orders to the petitioners herein."
5. Taking into consideration the facts and circumstances of case and submissions made by learned counsel for both sides, this writ petition is also disposed off in terms of WPC No.2306/2020 & WPS No.1690/2021. The respondents are directed to expeditiously consider and decide representation of petitioner for grant of permission to the petitioner for completing her course, in accordance with law, preferably within a period of three weeks from the date of receipt of certified copy of this order. The decision of respondents on the petitioner's representation will be communicate to him.
