Apprehending arrest in connection with Crime No.115/2019, registered at Police Station - Maudhapara, District - Raipur (C.G.) for offence punishable under Section 66 of the I.T. Act, the applicant has preferred this application for grant of anticipatory bail. 2.
The offence registered against the applicant is only under Section 66 of the I.T. Act, which is punishable with imprisonment either description maximum up to three years. According to Section 77-B of the I.T. Act itself, the offence punishable up to three years are of bailable in nature. Therefore, the application filed under Section 438 of Cr.P.C. for grant of anticipatory bail is not maintainable, which is disposed off.
