Hon'ble Shri Justice Goutam Bhaduri Order 02.09.2020 Heard.

1. This is the second round of litigation. Earlier the petitioner had filed a writ petition bearing WPS No. 3133 of 2019 wherein this Court on 30.04.2019 has observed that the petitioner's grievance shall be decided by the Deputy Registrar having jurisdiction under Section 55(2) of the Cooperatives Society Act.

2. Learned counsel for the petitioner submits that the petitioner is a senior citizen and he pursuant to the order dated 30.04.2019 has preferred an

appeal before the Deputy Registrar (Respondent No. 4) on 16.05.2019 (Anneuxre P-1). It is contended that the issue pertains to the retiral dues as the petitioner stand retired on 31.03.2019 (Annexure P-4). The limited prayer of the petitioner is that the appeal of the petitioner which is pending before Respondent No. 4 may be adjudicated within a reasonable period of time.

3. Considering the fact that the petitioner since has retired and the issue pertains to retiral dues, it is directed that the Respondent No. 4 shall decide the pending appeal (Anneuxre P-1) of the petitioner within a reasonable period of time preferably within an outer limit of 6 months from the date of receipt of a copy of this order.

4. It is made clear that this order may not be treated as precedent and it is passed looking to the present circumstances.
