This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 88/2013, registered at Police Station Lundra, District Sarguja (C.G.), for the offence punishable under Sections 363, 366, 376, 342, 506B, 34 of the I.P.C. two counts and Section 3(A)5(L) of Protection of

Child from Sexual Offences, 376(2)(N) of I.P.C. 2.

The applicant granted regular bail by order dated 24/11/2014 in M.Cr.C. No.5997/2014. He failed to appear before the trial Court on 18/02/2016 and thereafter, arrested on 20/03/2016.

Taking into consideration the facts and circumstances of the case; nature and gravity of offence and the ground shown for non-appearance on 18/02/2016, I am inclined to release the applicant on regular bail.

Accordingly, second bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. 6.
