The Applicant has preferred this First bail application under Section 439 of the Cr.P.C for grant of regular bail as he is arrested in connection with Crime No. 637/2018 registered at Police Station Thana Palari, Distt. Baloda Bazar- Bhatapara (C.G.) for the offence punishable under Section 420 of the IPC.

As per prosecution story, on 22/12/2018 Complainant Dipak Kumar lodged a written complaint alleging therein that in the year 2016, the Applicant, on the pretext to provide job of peon, had obtained Rs. 2,30,000/- from him. Thereafter, neither he provided job nor he returned the money. On the basis of said report, offence has been registered. The Applicant has been taken into custody on 05/03/2019.

Counsel appearing on behalf of the Applicant submits that the Applicant

has been falsely implicated in the present case. He is innocent. He is in jail since 05/03/2019, charge-sheet has been filed and trial will take time, therefore, the Applicant may be released on bail. 4.

Counsel appearing on behalf of the State opposes the bail application. 5.

I have heard learned counsel for the parties. 6.

Considering the entire facts and circumstances of the case, particularly, the Applicant is in custody since 05/03/2019, charge-sheet has been filed and trial will likely to take time, I am inclined to release the Applicant on bail.

Accordingly, the bail application is allowed. 8.

It is directed that the Applicant shall be released on bail on executing a personal bond for a sum of Rs. 20,000/- with one surety for the like amount to the satisfaction of the trial Court.
