Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 14/12/2017
1. Learned counsel for the petitioner would submit that petitioner's representation has been rejected by non speaking order without even mentioning the facts of the case.
2. The petitioner has assailed the transfer order dated 14-08-2017 by filing WPS No. 4314 of 2017 in which liberty was allowed in favour of the petitioner to move representation. The petitioner thereafter preferred representation which has been dismissed by the impugned order Annexure P-2.
3. Considering the entire facts situation of the case, it appears that the competent authority is required to reconsider the representation and pass a speaking order dealing with the grounds urged in the representation. Accordingly, the non speaking and unreasoned order Annexure P-2 is quashed and the respondents are directed to decide the representation afresh within a period of 8 weeks from today.
4. Till the representation is decided by speaking order, petitioner shall be allowed to continue at his present place of posting.
5. With the aforesaid observations and directions the writ petition stands disposed of.
