1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.307/2020 registered in Police Station: Telibandha, Raipur District Raipur for offence under Section 294, 307, 323, 34, 147, 148 & 149 of the IPC and Sections 25 & 27 of the Arms Act.

2. This is the 2nd bail application on behalf of the applicant. The first bail application was dismissed with liberty to revive the prayer after examination of two injured persons namely, Sheikh Haider and Afridi Mohd.

3. Learned counsel for the applicant draws attention of the Court to the

MCRC No. 5733 of 2021 order passed on 2.7.2021 in MCrC No.4175/2021 wherein bail has been allowed to Shubham Sahu whose bail application was also decided in the same order in which the applicant's earlier bail application was decided.

4. In the order passed in favour of Shubham Sahu in MCRC No.4175/2021, it has been observed that the aforesaid injured persons have been examined before the trial Court and they have refused to identify the applicant.

5. In the circumstances, this Court is inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
