The applicants have preferred this first bail application under Section 439 of CrPC, as they have been arrested in connection with Crime No.301/2020, registered at Police Station Bhatapara Gramin, District Baloda Bazar - Bhatapara (C.G.) for the offence punishable under Sections 406, 420 & 120-B read with Section 34 of IPC.

The case of the prosecution in brief is that the rice grains and other grains, valued more than Rs.19 Lakhs, were diverted and instead of being supplied to the destination, it was taken elsewhere. The allegation against the present applicant is that
the applicant was also involved in the entire conspiracy. 3.
The co-accused Ravikant Verma has been denied bail by the Coordinate Bench in MCRC No.5497/2020 vide order dated 20.10.2020.

The allegations against the co-accused Ravikant Verma and the present applicant are the same and both were involved in hatching the conspiracy of embezzlement of huge amount worth Rs.19 Lakhs. The present applicant is the owner of the vehicle involved in hatching the said conspiracy. Therefore, taking into consideration of involvement of the present applicant in the offence, huge amount of embezzlement worth Rs.19 Lakhs and the order of the Coordinate Bench rejecting the bail application of the-accused Ravikant Verma, this Court is not inclined to enlarge the applicant on bail.

Accordingly, the bail application is rejected. 6.
In case, trial is not commenced or concluded within 3 months of this order, the applicant would be at liberty to revive the bail application, as has also been granted by the Coordinate Bench in MCRC No.5497/2020.
