The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.67/2018 registered in Police Station Pandariya Dist. Kabirdham for offence punishable under section 306, 34 of IPC.

As per the prosecution case, on 7/04/2018 one Satrupa Bai committed suicide by setting herself ablaze. It is alleged that deceased was the second wife and Sunti Chandrakar was the first wife of Jalesh Chandrakar and both of them have abetted the deceased to commit suicide.

Learned counsel for the applicants submits that the deceased was the second wife and she could not go along with the family and there is no abetment, trivial dispute occurred which cannot be stated to be abetment. He submits that charge sheet has been filed, no further investigation would be necessary, they are in jail since 7/05/2018, therefore the
applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, statement of Nandini Bai mother of the deceased, charge sheet has been filed and applicants are in jail since 7/05/2018, this court is inclined to release the applicants on bail.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
