(1) The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 01/2016 registered at Police Station Kasdol, District Baloda Bazar- Bhatapara, CG for the offences punishable under Sections 456, 376 of the Indian Penal Code and Section 3(1)(xii) of the Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act.

(2) Applicant's first bail application was dismissed as withdrawn with liberty to file the same after material prosecution witnesses are examined by this Court by order dated 30.03.2016

passed in M.Cr.C. No.1696/2016.

(3) Having heard learned counsel for the applicant, having regard to the facts & circumstances of the case, I do not find any new or good ground to entertain this second bail application. Accordingly, the bail application is rejected. Sd/- (Sanjay K. Agrawal) Judge D/-
