This is second bail petition filed u/s 438 of the Code of Criminal Procedure in connection with Crime No.6/2015 registered at P.S. Ambikapur, Distt. Surguja (C.G) for the offence punishable u/s 313 Cr.P.C. The earlier bail application was dismissed on 14.03.2016.

After arguing for some time on the ground that termination of pregnancy was at the instance of doctor and medicines were given by a doctor to the complainant, no allegation can be attributed to the present applicant; the learned counsel for the applicant would submit that the applicant is lady aged about 48 years and is suffering from various deceases, therefore, she prays for withdrawal of the bail application with liberty to surrender and apply for regular before the court concerned. Prayer is not opposed by the learned State Counsel. The petitioner, if so advised, may surrender and apply for regular bail before the Court concerned and in the event if such application is filed before the concerned Court, the said Court shall consider and decide the same on merits as early as possible preferably on the same day.

This bail application is dismissed as withdrawn with the aforesaid liberty.
