Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 15/01/2016 (1) Learned counsel appearing for the petitioners would submit that petitioner and respondent No. 4, both are working as Sub Engineer in the Public Works Department and respondent No. 4 is junior to him but as the respondent No. 4 has been given charge of Assistant Engineer in violation of the Circular dated 4.8.2011 issued by the State Government, against which. he made representation to the competent authority, which has not been heard & decided till now and, therefore, he may be permitted to file fresh representation to the competent authority and the same may be directed to be decided within the specific time frame.

(2) Prayer appears to be fair & reasonable.

(3) Be that as it may, if the petitioner prefers fresh representation to the competent authority for redressal of his grievances within a period of two weeks from today, the authority concerned shall consider and decide the same in accordance with law in light of circular dated 4.8.2011 issued by the State Government expeditiously preferably within a period of 45 days from the receipt thereof. (4) With the aforesaid observations, the writ petition stands finally disposed of.
