1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 65/2016 registered at P.S. Azad Chowk, Distt. Raipur (C.G) for the offence punishable under Section 294, 506(B), 506(Part II), 324, 326/34 of IPC and Sections 25/27 of the Arms Act.
2. As per the prosecution case, on 07.03.2016 the complainant was sitting near the shop of a washer-man. At that time the applicant along-with other co-accused came there, abused him in filthy language and thereafter took out a knife and stabbed the complainant on his thigh thereby the offenece is committed.
3. Learned counsel for the applicant submits that only two injuries were caused and the applicant has been falsely implicated in this case. He further submits that even if the injuries are examined, only simple injuries were caused on
the thigh and no further evidence is required, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail.
5. Perused the statement of the complainant and the medical report.
6. Considering the statement of the complainant and the medical report, at this stage, I am not inclined to release the applicant on bail. Accordingly, this bail application is rejected.
