1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 298/2019 registered at Police Station Civil Line, Raipur, District Raipur (C.G.) for the offence punishable under Sections 4, 5 & 7 of the Immoral Traffic (Prevention) Act.

The prosecution story in brief is that on 30.04.2019, Station House Officer, Police Station Civil Line, Raipur received an information that at Bus Stand Shyam Plaza Sam Spa Centre, there are girls brought from outside for trafficking. On the basis of aforesaid information, the police authority conducted raid and arrested the applicant and other accused persons.

3. Learned counsel for the applicant submits that the applicant

is innocent person and he has falsely been implicated in the crime in question. He further submits that the other coaccused persons namely Hitesh Praveen Chouhan in MCRC No. 3333/2019, Priya Jaiswal @ Princy in MCRC No. 3424/2019 and Jepiholi Swu in MCRC No. 3514/2019 have been granted bail vide order dated 24.05.2019, therefore, the present applicant may also be released on bail.

4. On the other hand, counsel for the State opposes the bail application.

Taking into consideration the nature and gravity of the offence, facts and circumstances of the case, and further considering the facts that the other co-accused persons namely Hitesh Praveen Chouhan, Priya Jaiswal @ Princy & Jepiholi Swu have already been granted bail and the trial is likely to take some time for its final disposal, this Court is of the view that it is a fit case to release the applicant on bail. Accordingly, the application is allowed.

6. Accused/applicant is directed to be released on bail on his executing a personal bond in the sum of Rs. 50,000/- with two local sureties in the like sum to the satisfaction of the trial Court.
