The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 476/15 registered in Police Station Lormi, Civil District-Bilaspur, Revenue District-Mungeli (C.G.) for offence punishable under sections 420 of Indian Penal Code. 2.

As per the prosecution case, the applicant on 15/11/2013 received an amount of Rs.1,40,000/- from the complainant to provide him the job of cook and thereafter the job was not provided and the applicant also refused to pay back the amount. Thereby, the offence is committed. 3.

Learned counsel for the applicant submits the FIR was lodged on 29/10/2015, there is no plausible explanation has been given for the delay of FIR and the applicant has been falsely implicated in the case. He submits that charge sheet has been filed and the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Alleged incident is said

to be of the year November, 2013 and FIR was lodged on 29/10/2015. Considering the delay in lodging the FIR and also for the fact that charge sheet has been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
