This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 171/2015 registered at Police Station- G.R.P. Bilaspur District Bilaspur (C.G.) for the offence punishable under Sections 34(1)(A) (2) of Chhattisgarh Excise Act.

The earlier bail applications of the applicant was dismissed on 25.01.2016 and 26.04.2016 and it was observed that the liberty was given to repeat the bail application after examination of the material witnesses.

It is submitted by the counsel for the applicant that one seizure witness is still to be examined, therefore, under the circumstance, I am not inclined to entertain the instant bail petition. 4.
