Sam Koshy Order On Board 06.09.2018 The limited prayer which the petitioner has claimed in the present writ petition is that though the petitioner had become eligible for promotion way in the year 2014 and the post is also lying vacant yet the respondents for the reasons best known have not conducted a DPC and for all these periods thereby denying the rightful claim of the petitioner for being considered for promotion.

The rules governing the field envisage a clause wherein it is mandated that DPC should be held regularly, if not at least once a year. It
appears that there is no justified reason for not conducting a DPC for years together from 2014 given in the present case as per the contention of the petitioner.

Given the aforesaid facts, this Court does not intend to keep the petition pending by seeking a detail reply from the respondents. Ends of justice would serve if a direction is given to respondent no.1 to take a decision on the repeated representations filed by the petitioner at the earliest and at the same time they shall also consider for taking steps for holding a DPC for the post of Assistant Labour Commissioner (State). Let this exercise be started within a period of 90 days from the date of receipt of certified copy of this order.
