The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.48/2018 registered in Police Station Basna, District Mahasamund (C.G.) for offence punishable under sections 294, 323, 506, 302/34 of IPC.

As per the case of the prosecution, on 25/01/2018 the applicants on the previous enmity has assaulted one Ajay Yadav @ Chhabi Lal and he died because of head injury caused by brutal beating. 3.
Learned counsel for the applicants submits that the applicants have been falsely implicated in the case, the evidence would show that case under section 302 IPC is not made out, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the statement of Noj Kumar Nand who is eye witness. Considering the same, wherein direct allegations have been attributed and
also considering the postmortem report, this court is not inclined to release the applicants on bail.
