This writ petition is preferred for issuance of direction to the respondents No. 2 & 3 to relieve the petitioner for joining at the transferred place. 2.

Vide order dated 15/07/2014 petitioner has been transferred from Veterinary Hospital, Sukma, District Sukma to Veterinary Hospital, Khairagarh, District Rajnandgaon. When the petitioner was not relieved, he preferred a writ petition bearing W.P.(S) No. 4538/2014 which was disposed of on 02/09/2014 directing that the petitioner be relieved for the transferred place, subject however to compliance of any other administrative instructions issued by the State Government regarding relieving of an employee working in the scheduled area.

Since Sukma is a scheduled area, the petitioner was not relieved immediately, however, subsequently one Dr. Yogeshwar Patel has joined at Veterinary Hospital, Sukma and the petitioner has handed over charge to the said officer, yet the petitioner has not been relieved from Sukma so as to enable him to join at Khairagarh.

Considering the earlier order passed by this Court and for the fact that petitioner has already handed over charge to Dr. Yogeshwar Patel, the writ petition is disposed of with a direction to the respondent No.3 - Deputy Director, Veterinary Services, Sukma, District Sukma to forthwith relieve the petitioner. Any disobedience of this order shall be viewed seriously and this Court may initiate contempt proceedings against the respondent No.3. J U D G E Kamde
