1. This is the first bail application of the applicant, filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.65/2019, under Section 366, 376, 34 of IPC, registered at Police Station- Jashpur (C.G.).

2. Learned counsel for the appellant submits that he does not want to prosecute the appeal and seeks to withdraw the same. However, he prays for grant of liberty to file fresh appeal if trial does not conclude within six months.

3. Counsel for the State has no objection to the above prayer.

4. Permission granted.

5. Accordingly, the Criminal Appeal is dismissed as withdrawn with aforesaid liberty.
