Apprehending arrest in connection with Crime No.366/2015, registered at Police Station- Tarbahar, District - Bilaspur (C.G.), for offence punishable under Section 294, 506B, 324, 307, 34 of the Indian Penal Code, the applicant has preferred this application for grant of anticipatory bail.

As per the prosecution case on 21.12.2015 the complainant Vikash Yadav was going back to his house, at that time applicant along with other co-accused intercepted him and thereafter assaulted by way of sword, thereby offence has been committed.

Learned counsel for the applicant would submit that charge-sheet has been filed on 01.03.2016, therefore, the applicant may be extended the benefit of anticipatory bail.

Per contra, the learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. The first bail was rejected on merits on 22.02.2016 and after rejection of the first bail on 22.02.2016, no change of circumstances appears to be existed. Considering the allegation levelled against the applicant I am not inclined to reconsider the anticipatory bail. 6.
