This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 57/2016 registered at Police Station- Urla, District - Raipur (C.G.) for the offence punishable under Section 420 of Indian Penal Code. 2.
As per the prosecution case, in between period 28.01.2016 to 19.02.2016, the applicant in order to provide loan to the different beneficiaries under the Pradhan Mantri Yojna, obtained Rs. 12,200/- and gave them acknowledgement of forged documents. Subsequently, from the possession of the applicant Rs. 8300/- was recovered and certain application and documents were recovered. 3.
Counsel for the applicant submits that the applicant has been falsely implicated in this case. She further submits that the chargesheet has been filed and no further investigation is required and the applicant being lady she may be enlarged on bail. 4.
Learned State counsel opposes the prayer for grant of bail.

Perused the case diary. Taking into the fact that the charge sheet has been filed in this case and the allegations are documentary in nature and further taking into the fact the the applicant being lady and she is in jail since 19.02.2016, this Court is of the opinion, that present is a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Santosh
