The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No. 540/2009 registered in Police Station Kotwali, Ambikapur, District Surguja (C.G.) for offence punishable under sections 363, 367, 370, 374, 506B of Indian Penal Code. 2.

It is a case of bail jump. The applicant was enlarged on bail on 16/09/2009.

Learned counsel for the applicant submits that thereafter applicant was regularly appearing and on the date 13/10/2015 her daughter was not well and therefore she could not appear and on that date arrest warrant was issued and she was subsequently arrested on 25/02/2016 and produced before the court. It is further submitted that considering the fact that applicant was earlier released, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Taking into fact that the applicant is in jail since 25/02/2016 and she was earlier enlarged on bail and it is a case of bail jump, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
