Hon'ble Shri Justice Pritinker Diwaker Order On Board 07/08/2015 Grievance of the petitioner is that his father Late Indra Pratap Singh who was an employee of the State Government died on 26.8.1991 in harness but till date his case for compassionate appointment has not been decided. Counsel for the petitioner submits that purpose of filing this petition would be served if at this stage the petitioner may be permitted to withdraw this petition with liberty to pursue his pending representation, however, direction may be given to respondent No.3 to decide the pending case of the petitioner expeditiously.

State counsel has no objection to the proposition as put forth by the petitioner. He, however, submits that representation of the petitioner would be decided if the same has not already been considered and decided, in accordance with law. He further submits that the petitioner has approached this Court after an inordinate delay and therefore, liberty may be given to the State authorities to consider this point also. Petitioner is permitted to withdrawn this petition with the aforesaid liberty. In the eventuality of producing copy of this order by the petitioner before respondent No.3, it is expected from respondent No.3 to decide the pending case of the petitioner, if already not decided, in accordance with law, expeditiously.
