Petitioner has challenged the order passed by the Tahsildar, Nagri, District Dhamtari, whereby the application for grant of permanent caste certificate in favour of the daughter of the petitioner has been rejected.

At the very outset, Shri Sao, learned Dy. Advocate General, would fairly submit that since in the Chhattisgarh Scheduled Castes Scheduled Tribes and Other Backward Classes (Regulation of
Social Status Certification) Act, 2013, the Sub Divisional Officer (Revenue) (for short 'the SDO') is empowered to deal with the applications for grant of permanent caste certificate, if the petitioner prefers fresh application before the jurisdictional SDO, the same shall be considered and decided, in accordance with law and on its own merits.

In view of the above, the writ petition is disposed of with liberty to the petitioner to move fresh application for grant permanent caste certificate before the jurisdictional SDO.

It is made clear that while deciding the petitioner's fresh application the concerned SDO shall not be influenced by the earlier passed by the Tahsildar.
