Order On Board 11/05/2016

1. At the outset, learned counsel for the petitioner submits that he be permitted to withdraw instant CRMP with liberty to file criminal revision before the revisional court having jurisdiction against the impugned order passed by the Sub Divisional Magistrate, Kawardha in Criminal Case No. 72/2016 on 23-4-2016. It is further prayed that the revisional court be directed to hear the matter as expeditiously as possible.

2. On due consideration, instant CRMP is disposed of as withdrawn without entering into its merit reserving aforesaid liberty as prayed by the petitioner. The revisional court having jurisdiction is directed that if such revision is filed, the same shall be heard as expeditiously as possible.

3. Registry is directed to return the certified copy of the order filed along with the petition to the petitioner after retaining authenticated true copy of the same in the file.

4. No order as to costs.
