This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.154/2016, registered at Police Station - Supela, District - Durg (C.G.) for the offence punishable under Section 294, 506-B, 324, 326/34 of the Indian Penal Code.

Case of the prosecution, in brief, is that on 12.02.2016, while the complainant after taking petrol was coming out of pump he dashed the applicant and other co-accused and therefore they landed into altercation and scuffle and during such time, Ravi Kumar assaulted the complainant by way of blade on the cheek and right arm.

Learned counsel for the applicant submits that the applicant is in jail since 03.03.2016 and the nature of injuries are simple in nature and no further recovery and investigation is necessary. He further submits that considering the fact that charge-sheet in this case has been filed, the applicant may be released on bail.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel appearing for the parties. 6.

Considering the nature of injuries, which is stated to be simple in nature and further considering the fact that charge-sheet in this case has been filed and no further recovery and investigation is required and the applicant is in jail since 03.03.2016, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
