1. Heard.

2. This is a second application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.106/2020, registered at Police Station Civil Lines Raipur District Raipur, for the offence punishable under Section 20(B) of the NDPS Act.

3. As per learned State counsel, the earlier bail application was dismissed for the reason that the applicant was involved in committing similar offence in the past, however, since thereafter more than 9 months have been elapsed.

4. Case of the prosecution, in brief, is that the applicant was found in illicit possession of 8.00 kg of cannabis (ganja).

5. Considering the entire fact situation of the case as also for the fact that applicant is in jail since 23.2.2020 i.e., for more than one year and six months, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
