This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 2/2016 registered at Police Station Chando, Balrampur for offence punishable under Section 341, 323, 354 of IPC.

As per the prosecution case, on 8/01/2016 the prosecutrix was going alongwith her sister, at that time applicant came and caught hold of the victim and uttered that he will outrage her modesty which was objected by the younger sister of the victim, however it was not done and the applicant fled away. Subsequently, report was made.

Learned counsel for the applicant submits that because of the money dispute false allegations have been attributed to the applicant. Therefore, learned counsel submits that the applicant may be granted benefit of anticipatory bail.

Learned State counsel opposes the prayer for grant of anticipatory bail.

Perused the statement of the victim. Taking into statement of the
victim, I am not inclined to extend benefit of anticipatory bail to the applicant. 6.
Accordingly, the anticipatory bail application is dismissed. Certified copy as per rules.
