Taking into consideration the submission made by learned counsel for the State that even though wife (PW5) of the accused has clearly stated regarding quarrel between the accused and deceased and then deceased dead body was found at the spot and the husband was seen coming out with the axe in his hand and later on, axe is recovered at the instance of the husband, which was found to be human blood, acquittal has been granted, we are inclined to grant leave to appeal. Therefore, the application for grant of leave to appeal is allowed.

The appeal filed by the State be registered as an acquittal appeal and be listed for further orders.
