1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.380/2020 registered at Police Station Ambikapur, District Surguja for the offence punishable under Sections 392, 34, 411 of the IPC.
3. The applicant along with co-accused Ved Singh and Nan Badi have looted a bag from complainant Ku. Shweta Gupta, when
MCRC No. 5956 of 2020 she was proceeding towards Bharat Clinical Lab at 4:30 p.m. on 11.7.2020. In the looted bag, the complainant's mobile phone, ear phone, ATM cards, silver coin, Aadhar Card, Pan Car, tifÏn bottle and other documents along with cash of Rs.1000/- were kept.
4. Learned counsel for the State would oppose the bail application. However, he would inform that the concerned SHO has not reported any previous criminal antecedents of the applicant.
5. Considering that the offences are triable by the Judicial Magistrate First Class and the applicant is in jail since 25.7.2020 i.e. for more than 3 months, this Court is inclined to release the applicant on regular bail.`
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
