2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.68/2020 registered at Police Station Batouli, District Surguja for the

MCRC No. 5910 of 2020 offence punishable under Sections 394, 427, 34 of the IPC.

3. The applicants along with two other co-accused have looted Rs.7000/- from a truck driver on 6.8.2020. Co-accused Avinash Tirky has already been released on bail vide order dated 13.10.2020 passed in MCRC No.5967/2020.

4. The case of the present applicants is more or less similar to that of co-accused Avinash Tirky and the offences are triable by the Judicial Magistrate First Class. Therefore, since the applicants are in jail since 10.8.2020 and the charge sheet has already been filed, this Court is inclined to release the applicants on regular bail.

5. Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
