(1) Learned counsel appearing for the petitioner would submit that earlier the petitioner has been dismissed from the service pursuant to the conclusion of departmental enquiry finding him guilty of misconduct. Now, he has been acquitted of the charges by the jurisdictional Criminal Court on 30.07.2015 and, therefore, he may be allowed to make representation in view of the regulation 241 of the C.G. Police Regulations to the Superintendent of Police, Raipur and the same may be directed to be decided by the authority concerned within the specific time frame. To which, counsel for the State has no
objection.
(2) Prayer appears to be fair & reasonable.
(3) Accordingly, it is directed that petitioner shall file representation to the Superintendent of Police, Raipur within a period of 15 days and in turn the SP, Raipur shall decide the same in accordance with law expeditiously preferably within a period of two months from the date of receipt of copy of this order.
(4) With the aforesaid observations, the petition stands finally disposed of.
(5) It is made clear that this Court has not expressed any opinion on the merits of the case and the authority concerned is free to decide the representation of the petitioner in accordance with law. Sd/- (Sanjay K. Agrawal) Judge D/-
