2. The applicants have preferred this first bail application under Section 439 of CrPC, as they are arrested in connection with Crime No.148/2020, registered at Police Station Palari, District Baloda Bazar-Bhatapara (CG), for the offence

punishable under Sections 302, 201 & 120-B of the Indian Penal Code.

3. Applicants have committed murder of deceased namely; Yashwant Sahu, Devendra Sahu and Smt Maheshwari Sahu at 9.00 p.m. on 12.04.2020.

4. According to the prosecution case, applicant No.1 Ravishankar Shukla had an affair with the deceased Smt Maheshwari Sahu which was objected by her husband deceased Yashwant Sahu, therefore, applicant No.1 hatched a conspiracy with the other accused persons to commit murder of deceased Yashwant and in furtherance of said conspiracy they committed murder of deceased Yashwant and Devendra who were sleeping in one room and thereafter when the deceased Maheshwari awoke and started trying to save Yashwant, she too was murdered. On the memorandum statement of applicant No.1 the axe used for causing fatal assault has been recovered from his possession whereas bloodstained clothes have been recovered from the remaining two applicants.

5. Considering the entire facts situation of the case and particularly considering the fact that it is a case of triple murder and recovery of incriminating articles have been made against the applicants, this Court is not inclined to grant bail to the applicants at this stage.
